OBAMA'S "SWINDLE OF THE YEAR"

From his Senate Conservatives Fund, Senator Jim DeMint wrote a detailed letter about the so-called 'compromise' to extend the Bush era tax rates. On the one side, it's Democrats as usual with their spend addiction and committed re-distribution of wealth at the expense of our children and grandchildren, but the other side is the most disturbing of all - Republicans have not seen the error of their ways.

It's almost as bad as Obamacare -- the more you read it, the worse it gets. Talk about Pork, it's loaded with it (and they keep adding more, the longer this drags out), along with more and more deficit spending. The Beltway must be a magical sort of Disneyland, where over spending has no ramifications, because Republicans are not holding up to their part of the November 2nd agreement, and have gone back to spending. That, or else they are not looking at what the other hand is doing. It's hard to believe they are that blind.

At this point, you gotta know Obama doesn't do anything without reaping loads of rewards on the back end. This mis-worded compromise is full of little goodies, such as scheduling unemployment to expire at Christmastime; the Bush tax rates to expire just in time for the 2012 re-election (scary thought, re-election); and more pay-offs to his cronies, including the unions. On-line gambling? Are you kidding me? In other words, as Charles Krauthammer writes, Obama just pulled a fast one on the Republicans.

Most of us want to spend the next two weeks before Christmas having fun shopping, gathering with friends and family, and rejoicing in the birth of Christ. But the next two weeks is all this Lame Duck session needs to add destruction to an already weakened country and economy. We can't let this happen. We worked too hard, and have been sold a cheap bag of Obama tricks.

If we have to bite the bullet for a month or two, so be it. It's far better than another close to trillion dollars in debt. We can't afford it. We don't have the money. Congress can pass a bill next month, that deals with extending the Bush tax rates only. Not more spending. And, they can make it retro-active. Americans had to deal with Clinton's tax increases retro-actively. It can be done. Republicans will have the majority. Nancy Pelosi has been fired. She no longer has the power, unless we give it back to her.

Read Senator DeMint's letter below (and Krauthammer's "Swindle of the Year"), and let's get to work. We can rejoice on Christmas Day, but in the meantime call, fax, and email our Congress that this is not the compromise we voted for. We can't move forward towards ending the deficit and recovering our economy by spending at the same time.

Have we been hood-winked again? What happened to no earmarks, no new spending, reduce the deficit? Here's some contact numbers for our elected officials. Page 1, Page 2, Page 3, Page 4, Page 5. (Click on page to enlarge)

Obama wants this so-called 'compromise' desperately. You gotta ask yourself -- WHY?

From United States Senator Jim DeMint
Senate Conservatives Fund
December 10, 2010

Dear Fellow Conservatives:

Many of you have contacted me about the bipartisan tax deal reached between President Obama and Republican leaders. I've carefully reviewed the legislation and I wanted to explain to you why I cannot support it.

First, I do not want to see anyone's taxes go up and I have been fighting for years to permanently extend all the tax rates. I disagree with the President that we cannot afford to extend these rates for everyone. It's the people's money and we should not raise taxes on hardworking American families.

But this bill does much more than simply extend tax rates.

For starters, it includes approximately $200 billion in new deficit spending and stimulus gimmicks. That's a lot of money that will have to be borrowed from China and repaid by our children and grandchildren. If we're going to increase spending on new programs, we must reduce other spending to pay for it.

The bill also only extends rates for two years. We don't have a temporary economy so we shouldn't have temporary tax rates. Individuals and businesses make decisions looking at the long-term and we're not going to create jobs without giving people certainty as to what their taxes will be in future.

The bill also fails to extend all of the tax rates. It actually increases the death tax from its current rate of zero percent all the way up to 35 percent. One economic study shows that this tax increase alone will kill over 800,000 jobs over the next ten years.

Finally, the bill now includes dozens of earmarks for special interests, including ethanol subsidies, tax breaks for film and television producers, give aways for Puerto Rican rum manufacturers, favors for auto racing track owners, and a hand out for businesses in American Samoa.

The President called Republicans "hostage takers" this week but he should be pointing his figure squarely at himself. We've known for years that these tax rates were going to expire but he did nothing about it until the last minute. Now Americans are being told they have to accept hundreds of billions in new spending and stimulus gimmicks, an increase the death tax, and a bunch of unnecessary earmarks or their taxes will go up.

I'm not going to be bullied into voting for things that will hurt our country because politicians in Washington ignored the problem until it was a crisis.

Many of you fought hard to elect new leaders to the Senate this year with the expectation that they would fight deficit spending, tax hikes, and backroom deals. I take that commitment very seriously and I'm prepared to vote against this bill even if I'm the only one in the Senate to do so.

I appreciate the efforts made by my party's leaders to negotiate this deal but I believe Americans deserve much better. This deal should be rejected and then fixed. We can easily extend these tax rates without increasing spending once the new crop of Republican senators, including Pat Toomey, Marco Rubio, Rand Paul, Mike Lee, and Ron Johnson, are sworn in. The President has already conceded that taxes cannot go up and we'll have more Republicans in Congress in a few weeks to fight for a better deal.

Thank you for supporting the principles of freedom and for your continued encouragement. I will continue to do my very best to be your voice in the United States Senate.

Respectfully,

Jim DeMint

PLAYING WITH THE TWO IMMUTABLE LAWS OF WASHINGTON

It stinks. The only satisfaction was watching a defeated president pout, blame and lie, while the über left self-destructed. The left has finally realized that they lost power, and it isn't pretty. But.... Obama has exposed his true ideological self -- more pluses.

Where do we start on the negative side.
  • Small businesses have a temporary tax relief, but 2 years may not be long enough for them to extend the risks necessary for economic growth, including new jobs. It should have been permanent.
  • Unemployment has just been subsidized by tax paying Americans in extending an additional 13 months, for a total of 3 years. Notice the unusual amount of 13? That's so the next extension falls on Christmas next year, and just as in 2010, no one wants to cut off free money at Christmastime.
  • The 2 percent cut in social security is another re-distribution of wealth for people who don't pay taxes, and guarantees that social security will be at death's door.
  • The Death Tax is still going to be resurrected, although at a lower rate. Neverless, it's baa-ack. Taxes on money that has already been taxed. Wasn't there a revolution on double taxation?
No wonder Obama has conceded. This whole plan is a major re-distribution of wealth.

While Obama is playing as though he has made the supreme sacrifice, methinks he thinks this will play out to his advantage in the 2012 elections. "For the good of the people" has nothing to do with his decision. After all, it's always about him.

Red State's Erick Erickson writes an excellent piece, in his usual fashion, on what the American people get out of Obama's great sacrifice.

Playing With the Two Immutable Laws of Washington
by Erick Erickson - December 6, 2010

There are two immutable laws of Washington, D.C. To understand the tax compromise in the Senate, you must know the laws.
  1. Politicians in leadership believe that if they make both the left and right angry they must have done something right; and,
  2. If Democrats and Republicans come together in a compromise — no matter how bad that compromise may be — the media will herald the compromise and inevitably use the word “tone” in discussing it.
Then there is a corollary to the two rules: people who want a seat at the table with the politicians and media will turn into sycophants and tell you how delicious the compromise tastes.

Understanding those two immutable rules and the corollary tell you all you’ll need to understand about how the tax compromise will be played. Let’s review what the compromise is:
  • Extend current tax rates for two years
  • Extend unemployment benefit for another 13 months
  • A two percent cut in the payroll tax for next year
  • Death tax of 35% imposed above $5 million
We can first laugh about Alan Simpson and Erskine Bowles. After all that work, lecturing, and lamenting they have been, in one act, put back under the rock from whence they came.

There will be no more hand wringing over saving social security and the deficit. We’re going to blow it up. Ironically, we’re going to blow it up to preserve today’s tax rates and resurrect the death tax.

Second, we can laugh at the Democrats who are in full meltdown over the Democrats daring to extend current tax rates for everyone. For all the left’s talk about equality over freedom, the left believes they can treat the most successful with the greatest disdain and take away the freedom to take risks in this country and replace it with servitude to government.

Had Obama shown any leadership, he could have gotten this passed months ago on the grounds that it’d help stem losses in the midterms. But he didn’t, despite pressure from many Blue Dogs who will, in less than a month, be called “former congressman.”

Just last week Mr. Obama said, in his weekly radio address, “I believe we can’t afford to borrow and spend another $700 billion on permanent tax cuts for millionaires and billionaires.” My what a difference a week makes.

Ultimately though, this is a compromise that leaves both sides coming up short and is full of compromising the GOP did not have to engage in, even without controlling the Senate. They could have gotten more. We will also continue subsidizing unemployment — yes you read that right. At some point it becomes welfare, not unemployment compensation.

The compromise does little to stem the tide of uncertainty that has kept businesses from hiring. Because the fight will be wrapped up in the politics of 2012, small businesses that have been keeping money on the sidelines will keep doing so. Any politician who says this has anything to do with job creation will largely be lying.

Nonetheless, we know this much is true: the media, after weeks of taking the Deficit Commission seriously, and many of the politicians who have done the same will celebrate this grand act of bipartisan comity.

For months, the Democrats have said they would never support extending the current tax rates because of their concern for the deficit. They will now.

For months, the GOP has said they would never vote to raise taxes and will now vote to raise taxes by resurrecting the death tax instead of killing it — the only reason being Jon Kyl (R-AZ) wanted to bring it back and has held this position for a while.

For months, both sides have claimed they were committed to saving social security. Instead, they will cut the payroll tax thereby bringing the bankruptcy of social security even closer.

We will know who the real conservatives are in Congress. They’ll be the Republicans who oppose this deal.

But hey, it is bipartisan!

Maybe we can get Jeff Flake to primary Jon Kyl. . .

QUESTIONS FOR CONGRESSIONAL CANDIDATES

As the Nov 2nd elections are finally within reach, we are witnessing the onslaught of a herd of wolves in sheep's clothing. Suddenly the Democrats are talking like conservatives, but their voting records show these people are lying.

Will Americans be fooled this time? Will they fall for the smooth talking leftists who cannot run on their victories over the past 20 months? Say it ain't so, Joe.

The left voted over 90% of the time with either Pelosi, Reid, Obama, or all three and these three are perfectly happy to be temporarily dissed, as long as the Democrat candidates win, so that they can maintain the absolute power they have enjoyed over the past miserable 20 months.

Shows how strongly they stand behind their principles.

In her Eagle Forum, the quick-witted and knowledgeable Phyllis Schlafly lays out some excellent questions that should be asked of ALL candidates -- of both parties -- to help make that final decision where to cast their vote.

Questions for Congressional Candidates
by Phyllis Schlafly - October 8, 2010

We look forward to the 2010 elections in the hope that we can decisively reject Barack Obama's plans to "fundamentally transform the United States." Here are some questions voters can ask all candidates to help decide whom to vote for.

  • Will you vote against all tax increases and new taxes?
  • Will you vote to extend all the Republican tax cuts?
  • Will you vote to cut federal spending to the pre-bailout level?
  • Will you vote to abolish the death tax without passing a new tax (called "carryover basis") on the sale of inherited property?
  • Will you pledge to vote to repeal Obamacare?
  • Will you vote for legislation providing that all health plans receiving federal tax benefits include the availability of high-deductible insurance with health savings accounts?
  • Will you pledge to enact a government-wide ban on the funding of abortions in any health plan that receives federal benefits?
  • Will you pledge to vote against any form of amnesty for illegal aliens?
  • Will you vote to cut off funds for the Attorney General to sue to get a judge to knock out Arizona's popular immigration-enforcement law?
  • Will you vote to require employers to use the E-Verify system to verify the Social Security numbers of their employees?
  • Will you order the federal government to build the fence on our southern border as legislated in the Secure Fence Act of 2006?
  • Will you send U.S. troops to our southern border to prevent illegal entry?
  • Will you vote for legislation providing that no judge can force the government to communicate with anyone in a language other than English?
  • Will you vote for legislation requiring that aliens seeking to enter or remain in the United States must renounce a belief in jihad, sharia, polygamy, child marriage, arranged marriage, "honor" killings, and female genital mutilation?
  • Will you vote to prohibit Mexican trucks on U.S. roads?
  • Will you vote to stop giving the benefits of U.S. citizenship to babies ("anchor babies") born to illegal aliens?
  • Will you vote for legislation repealing EMTALA (which requires hospitals to provide free medical care to illegal aliens) and limiting Plyler v. Doe (which requires public schools to give a free education to the children of illegal aliens)?
  • Will you vote against any bills that exceed the enumerated constitutional powers of Congress?
  • Will you vote to prohibit the use of taxpayers' funds for any activity designed to promote economic or political union with North America or any foreign countries?
  • Will you pledge to vote No on increased federal involvement in education?
  • Will you urge congressional committee chairmen to hold public hearings on the grab for legislative powers by supremacist judges, and then take appropriate action to require the judiciary to respect the separation of powers?
  • Will you vote to tie federal school appropriations to informed, written parental consent for curricula, surveys, classes or books that may be privacy-invading or offensive to religion or conscience?
  • Will you vote to defund Planned Parenthood?
  • Will you pledge to vote No on any attempt to repeal DOMA?
  • Will you support the right of all fit parents to the care, custody, and control of the upbringing of their children, even if parents are divorced?
  • Will you vote No on any effort to revive the so-called Equal Rights Amendment and on any legislation implying that the ERA, which expired in 1982, is still somehow viable?
  • Will you vote against repeal of the law that forbids open homosexuals from serving in our military?
  • Will you oppose any and all proposals for a national Constitutional Convention (known as a Con Con)?
  • Will you oppose any attempt to bypass the Electoral College by a vote-transfer deceit called National Popular Vote?
  • Will you vote against any legislation to pretend that the District of Columbia is a state and entitled to a state's representation in Congress?
  • Will you vote No on any carbon tax or cap-and-trade bill?
  • Will you vote to eliminate the ban on our favorite light bulbs?
  • Will you vote No on Card Check that eliminates the secret ballot in workers' elections?
  • Will you vote for legislation providing that actions claiming a violation of the Establishment Clause shall not be eligible for an award of attorney's fees?
Questions especially for Senate candidates:

  • Will you vote No on the New START Treaty, which would restrict our right to build anti-missile defenses?
  • Will you vote No on the UN Law of the Sea Treaty?
  • Will you vote No on the UN Treaty on the Rights of the Child?
  • Will you vote No on the UN Treaty on Women (known as CEDAW)?
  • Will you vote against any judicial nominee who espouses the unconstitutional theories of a "living" or "evolving" Constitution, or an "activist" judiciary?
The more Yes answers to these questions, the more support the candidate deserves.

WHAT BARACK OBAMA IS THINKING

So, Obama thinks he's the second coming of FDR, but he has a rude awakening. He's not, and it's not the 1930's. America has come a long way in 70+ years, and once again the left wing radicals have underestimated the American people. It would also take someone far more experienced than this guy, who is the "least qualified, and least experienced guy in the room". But, that will not stop him from trying to 'fundamentally transform' us.

In the process, Obama is spending more money than all the presidents before him in total, grabbing as much power as he possibly can before the clock runs out, enabling our enemies and insulting our allies. All this while not doing the job of a sitting president. The disaster in the Gulf of Mexico speaks volumns on his performance and priorities.

Peter Ferrara writes an excellent piece in American Spectator about another historic parallel, re-iterating once again about repearing the errors of the past:

What Barack Obama Is Thinking
by Peter Ferrara, May 26, 2010

Students of history will recognize the method to President Obama's madness. The parallels in both policy and politics to the Roosevelt Administration are too striking not to be deliberate. President Obama is consciously modeling his Administration on the Roosevelt Administration. But just as the liberals of the 1930s graduated to the New Left of the 1960s, President Obama's policies and politics transcend the liberalism of the 1930s. He is building what Newt Gingrich rightly calls a 'secular socialist machine' in his new book To Save America.

Unreconstructed Keynesian Economics
Roosevelt's Keynesian economics was left for dead in the 1980s with President Reagan's supply-side revolution miraculously ending the stagflation of the 1970s with a 25-year economic boom. But President Obama came into office talking as if that never happened, casting it down the memory hole. While Reagan's early 1981 budget cuts slashed the federal budget by about 5%, Obama rammed through an almost $1 trillion stimulus package of nearly all Keynesian economics from the 1930s, laughing at his astounded critics with the question, "What do you think a stimulus is?"

Economically, it didn't work, just as it didn't in the 1930s or the 1970s. Now 29 months after the recession officially started in December, 2007, unemployment is 10% and rising, and the stock market is again stumbling, with the Dow still 4000 points off its last highs. The recovery was overdue a year ago, and even now economic growth is not half what it should be.

But note how the stimulus spending was structured so that more is spent this year than last. Was the goal to reduce unemployment as quickly as possible, or to use the guise of Keynesian stimulus spending for a political slush fund to buy as many votes as possible in this political year? Note also that about half of the direct "stimulus" spending went to state and local governments to prop up the employment of public employees, the most reliable supporters of liberal Democrat candidates. The only thing President Obama's stimulus is stimulating is a left-wing Democrat political machine.

Attack on Wall Street
Another early central theme of the Roosevelt Administration was a searing attack on Wall Street. The famed Pecora hearings, led by the Chief Counsel to the Senate Banking Committee Ferdinand Pecora, crucified top Wall Street bankers and brokers as the cause of the Depression. Despite the hallowed political propaganda long taught to American schoolchildren, Wall Street misdeeds played only a minor bit role in the Great Depression. The real causes were Fed mismanagement enabling a drastic collapse of the money supply, causing ruinous deflation, followed by brutal tax rate increases, and the soaring protectionist tariffs of the Smoot-Hawley Act. Roosevelt's massive overregulation and Keynesian economics draining private sector investment were additional factors extending the Depression for a decade, putting the "Great" into the "Great Depression" as Amity Shlaes put it in her eye-opening book, The Forgotten Man.

But the Pecora hearings and Roosevelt's class warfare rhetoric excoriating "the malefactors of great wealth" successfully shifted the blame politically from the government to the private sector. The result was passage of the Securities Act of 1933 and the Securities Exchange Act of 1934, imposing extensive new regulation on Wall Street, as if that would resolve the causes of the Depression. The measures did not produce economic recovery, but rather mostly just decades of voluminous securities filings filled with meaningless boilerplate that nobody ever read.

Today we see President Obama trying to pull off the exact same thing. The Democrats managed to inspire union-generated civil unrest with their incendiary rhetoric regarding contractually specified Wall Street "bonuses." The statesman Obama then poured oil on the fire, explaining,

The people on Wall Street still don't get it. They're still puzzled why is it that people are mad at the banks? Well, let's see. You know, you guys are drawing down 10-, 20-million-dollar bonuses after America went through the worst economic year that it's gone through in decades, and you guys caused the problem. And we got 10% unemployment.

But actually, no, Washington, it was "you guys" who caused the problem. The Fed again started it, this time with excessively loose monetary policy during the Bush Administration keeping real interest rates below zero for years, as explained by Stanford monetary policy guru John Taylor in his book Getting Off Track. That policy essentially subsidized excessive leverage and runaway risk.

Those cheap dollar, easy money policies joined with the "affordable housing" policies of the Clinton Administration and Congressional Democrats to create the housing bubble, pumped up by subprime mortgages going to people who couldn't afford them, or who were just speculating and willing to abandon their homes if they got into trouble. The Congressionally sponsored, financial terrorist organizations Fannie Mae and Freddie Mac then spread trillions in toxic securities backed by these subprime mortgages throughout the global financial system, ultimately threatening to bring it all down.

Following Roosevelt, President Obama again used the crisis to enact further government regulation of Wall Street in the financial regulatory reform bill. But Obama's regulatory monster makes Roosevelt's Wall Street regulation look like a sellout. Obama's bill effectively takes over Wall Street, institutionalizing bailouts with comprehensive new federal authority to seize any institution the government deems troubled. That power does not even have to be used, for the financial industry to become a house pet of the Democrat political machine, with President Obama's new billy club always ready and waiting in the closet. Don't expect to see any Republican fundraisers on Wall Street any time soon. Those are all Democrat affairs now, collecting protection money.

Further following the Roosevelt model, the Obama Administration inaugurated the Congressional debate on the financial regulation bill with a trumped-up, show-trial securities fraud suit against Goldman Sachs. Any free market advocate has to detest Goldman, which already has long been a central cog in the Democrat political machine. But the civil fraud suit against Goldman is an abuse of power, alleging essentially that Goldman defrauded itself into $75 million in losses in sponsoring an investment vehicle demanded by the market, which enabled investors to bet either for or against the subprime housing bubble. The suit is so contrary to legal precedent and the basic facts that the government prosecutors richly deserve sanctions, and if it ends with the deserved judicial excoriation, remember you read it here first.

In the end, two of the actual malefactors of the great wealth of government power themselves at the root of the housing bubble crisis, Barney Frank and Chris Dodd, stood taking credit for the financial reg reform bill, which will only add to the secular socialist machine rather than address the root causes of the financial crisis.

Crony Capitalism
Another major portion of the stimulus went to subsidies for so-called "green" energy, solar, wind, biofuels, etc. This was supposed to create "green" jobs, with President Obama proclaiming, "The nation that leads the green energy economy will be the nation that leads the global economy." (The global warming scientific grounds for such subsidies are sheer fantasy as discussed at length in this column many times before). Last year, a study of the experience with such subsidies in Spain found that they destroyed 2.2 jobs elsewhere in the economy for every green energy job created. High cost energy that has to be heavily subsidized with taxpayer dollars is not a good strategy for creating jobs.

More recently, a leaked Spanish government study estimates even greater net job losses. As Chris Horner of the Competitive Enterprise Institute reported last week at Pajamas Media, the Socialist Party Spanish government has publicly acknowledged that its green energy subsidy program has to be drastically curtailed if not abandoned altogether, "lest the experiment risk Spain becoming Greece." Investors Business Daily further reported last Friday a new study of green energy subsidies in Italy considering the full impact of the higher energy costs on the economy, and concluding, "Each green job cost 6.9 jobs in the industrial sector and 4.8 jobs across the entire economy." Indeed, high energy costs kill manufacturing.

But while green energy corporate welfare fails miserably as economics, it succeeds politically in building the Obama/Democrat political machine. All the "businesses" that exist, whether wind, solar, ethanol, or others, solely because of their Democrat party benefactors now also have trade associations that will join in contributing and openly campaigning for continued Democrat party majorities, especially as Tea Party conservatives exhibit greater clout in the Republican Party, defeating RINOs.

The same strategy is now being pursued in the new Kerry-Lieberman cap and trade bill, structured to deliver billions and billions to corporate interests to buy off their potential opposition. If that bill becomes law, all these businesses will be added to the Obama/Democrat political machine as well.

Government Dependency
President Obama has also followed Roosevelt's creation of massive new entitlements with the Obamacare takeover of health care. If not repealed, that government takeover will mean the end of high quality American health care, with government bureaucrats ultimately deciding what health care you can receive in service of the cause of "social justice" rather than your personal health.

But in the process, the legislation massively increases government dependency with an estimated trillion dollars in increased welfare providing health insurance subsidies for families making as much as $88,000 per year. Those cost estimates will prove woefully inadequate, as the legislation will likely cost at least 3 times as much, if not following Medicare in costing 10 times original estimates. But the ultimate cost does not matter to President Obama. What matters is that he considers the votes of everyone receiving the new entitlement benefits to be bought and paid for as part of the New Left political machine. The same politics are reflected in the one-third increase in federal welfare spending President Obama has already adopted in his first two years alone, with total national welfare spending now to cost an astounding $10.3 trillion over the next 10 years.

Like Roosevelt, Obama has thoroughly aligned himself with the labor unions, even though the great majority of workers today have rejected unionism as not in their best interests. Just as Roosevelt's 1935 Wagner Act heavily favoring the institutional interests of unions over the interests of workers until corrected by the 1947 Taft Hartley Act, Obama today seeks to pass card check legislation that would take away the vote of working people over unionization. It would effectively turn small and medium businesses over to union organizers as well through mandatory, 90 day arbitration dictating the terms and conditions of union contracts. Besides the massive auto bailout, actually a bailout for the UAW, Obama seeks to overturn the careful balance of traditional labor law through every means possible, including the appointment of radical leftists like Craig Becker to controlling labor-related government positions. Expanding unions, of course, just further expands the Obama/Democrat political machine.

President Obama's misrepresentation and defamation of the Arizona immigration control law is a further, naked attempt to build his secular socialist machine. That law was carefully crafted only to enforce current legal requirements of federal law. It also expressly prohibits racial profiling, allowing officers to investigate immigration status only during otherwise lawful contacts arising out of other matters, and only when there is probable cause to question such status. Yet Obama sponsors Mexican President Felipe Calderon before a joint session of Congress misrepresenting the Arizona law and effectively denouncing America, to the great applause and glee of Congressional Democrats, while Mexico maintains punitive immigration laws. Obama here is simply trying to rile up his Hispanic voter base for this year's elections.

In short, President Obama and the Democrats are trying to nationalize the urban political machines dating back to New York City's Tammany Hall that have long been the backbone of the Democrat party.

It Won't Work
But it won't work. Only an intellectually cloistered prep school Marxist could think the politics of the 1930s would be an effective model for today's modern America 75 years later. While America's old media and brain freeze academia are part of the Obama/Democrat New Left political machine as well, they are effectively countered today by the modern media of the Internet, cable and satellite TV, talk radio, nationally distributed conservative newspapers and magazines, and the conservative and libertarian think tanks and grassroots organizations.

In this environment, the Obama/Democrat political machine cannot survive the substantive policy failures that will blast it to smithereens over the next 24 months. We are enjoying now the high point of the Obama economy, a natural cyclical recovery that Obama has already managed to stunt to my own surprise. Yet the ultraliberalism of Washington's ruling Democrats is already cratering their political fortunes. When the concrete economic disasters of the 1970s begin to reappear next year with a new economic downturn, President Obama and his propagandists are not going to be able to talk their way out of political chaos. The American people are far too sophisticated now and have experienced too many years of bountiful prosperity to settle for the stagnation of European and Latin American socialism that Obama and Pelosi are brewing.

Compounding this is a trajectory of grievous foreign policy reversals, with President Obama inviting War through Weakness in the Middle East and elsewhere, and mushrooming nuclear proliferation in response to the now emerging nuclear Iran. The likely result of all this is a geometrically worsening downward spiral of political collapse for the Obama Democrats.

The better political survival strategy for the Democrats is the Blue Dog Democrat ploy that continued to work in the Pennsylvania 12 special election last week. But even that shows the weakness of the Obamunistas. In a two to one Democrat district, represented by Democrats for decades, with the national union infrastructure able to focus all of their resources on that one race, the Democrat won campaigning against the Obama agenda on a Rush Limbaugh platform. Will Obama really be able to maintain his leftist agenda with a Congress increasingly populated by those winning in this way?

Republicans must and will learn to counter this more effectively by aggressively attacking and exposing Blue Dog double dealing. Even more important, they must get much better at projecting a vision and theme of renewed American prosperity and growth.

GOP ON TRACK TO SNATCH DEFEAT FROM JAWS OF VICTORY

The recent primaries have unleashed a miriad of emotions, which must be paralleled to a sign of our time. Never in our short history has there been such turmoil, and that is not to diminish the very difficult times America has fought herself through. You have to admit that what we witnessed this past week is a first, and has infuriated the majority of American citizens. It's almost as though this was planned by a cunning and crafty president.

We have become a nation severely divided, thanks to the president, who was annointed to be post-racial, when, in fact, the opposite is true. Obama prepped and allowed a foreign dignitary, President Calderon of Mexico, to trash the United States of America on the floor of a Joint Session of Congress, while the radical left congressional members gave him a standing ovation, including AG Holder and HS Napolitano.

He has a lot of nerve to lecture us, while his own country has far more stringent laws, and whose own country is in turmoil. Thank God for Senator McClintock, who did not let this attack go unanswered.

Americans are desperate to reverse this train wreck towards socialism, but in their desperation, conservatives are becoming unraveled. This cannot happen, or we are surely looking at an endless term of Obamanites. Rather than looking at the mainstream media's affliction towards conservatives, we should focus on the positive and concentrate on what to do between now and this coming November's critical elections. Let's not put the cart before the horse, or count our chickens before they're hatched.

We will get there, but we cannot run amuck. Ann Coulter writes her take on the primaries in World Net Daily. She is always good for a picker-upper:

GOP on Track to Snatch Defeat From Jaws of Victory

Republican consultants are doing a wonderful job raising expectations sky-high for the November elections, so that now, even if Republicans do smashingly well, it will look like a defeat (and an across-the-board endorsement of Obama's agenda). Thanks, Republicans!

That's what happened in the 1998 congressional elections, nearly foiling Clinton's impeachment. It's what happened to the Conservative Party in Britain a week ago. And that's what happened this week in the 12th Congressional District of Pennsylvania, formerly represented by Rep. John Murtha.

Note to Republicans: Whenever possible, victory parties should be held after the election, not before it.

The result of the election in Murtha's old district on Tuesday was that the rabidly anti-Obamacare, pro-life, pro-gun candidate won! Yippee!

But the news on Wednesday morning was that the election "dealt a blow to Republicans," as the New York Times reported.

The reason the Times' description was not utter madness (in violation of New York Times' official policy) is because the anti-Obamacare, pro-life, pro-gun candidate was a Democrat, and, for the past two months, every Republican on TV has been predicting a Republican victory in Murtha's district.

Thanks to all the happy talk, if the Republican actually had won, it would have been Page 16 news. But when the Democrat won, it seemed like an against-all-odds, come-from-behind Hoosiers victory!

Why were Republicans predicting victory in a district where Democrats outnumber Republicans 2-1? Given a choice between two candidates who both hate Obamacare, why would lifelong Democrats not vote for the Democrat?

Republicans are playing the same raised-expectations game with the November elections. Republican House Minority Leader John Boehner is ludicrously predicting Republicans will pick up 100 seats in the House in November. Newt Gingrich puts the figure at an equally insane (and weirdly precise) 78. He also predicts the Cubs will win 132 games this season and six games will be rained out.

Keep it up, Republicans, and I'm going to keep naming names. I have Nexis.

For more than half a century, the average midterm pickup for the party out of power has been 24 seats.

Your job, Republicans, is not to go on Fox News and whisper sweet nothings in conservatives' ears. Your job is to repeal the Obama agenda. Raising expectations so high that a 30-seat Republican pickup will seem like a loss is not helping.

Moreover, we're not going to pick up any seats this November if Republicans keep chumming around with the Democrats' pals on Wall Street.

Roughly since the Harding administration, Wall Street has overwhelmingly favored Democrats. According to a recent report from ABC News, for example, the five largest hedge funds gave "almost all their donations to Democrats."

For the past year, the Democrats' Wall Street BFFs have had lower public approval ratings than Hitler. (When I say "Hitler," I don't mean Dick Cheney or George W. Bush; I actually mean Adolf Hitler.) While Hitler continues to enjoy great personal popularity, there is a growing dissatisfaction with his policies.

How could Republicans possibly screw that up? We try harder.

No sooner had the news come out that Goldman Sachs (Joseph Goebbels in this metaphor) had given Obama an astronomical $1 million in campaign donations, than Republican John Boehner decided that this was the time to suck up to Wall Street! So Boehner flew to New York to meet with Wall Street bankers and ask them to be Republicans' friends.

Boehner is like the guy who just got raped in prison and doesn't know what happened to him. Hey – what was that? Should I have thanked the guy?

As Pat Caddell says, Democrats are whores, but they expect to be paid; Republicans' names are scrawled on the bathroom wall: "For a good time, call the GOP!"

As depressing as it is to watch the Republican Party dive headlong off a cliff, at least we have Dick Blumenthal.

Connecticut's attorney general, pompous, freakishly ambitious, self-righteous, hold-a-press-conference-every-day Blumenthal, was a shoo-in to take Chris Dodd's Senate seat this fall.

After all, he was a Medal of Honor, Distinguished Service Cross, Silver Star and Purple Heart winner from his days as a four-star general in Vietnam. (And captain of the Harvard swim team to boot!)

But now we find out from a front-page article in the New York Times that, despite Blumenthal's repeated references to serving "in Vietnam" – he was never in Vietnam. He got five draft deferments and then joined an elite unit of the Marine Reserves to avoid going to war, serving in their heroic "Toys for Tots" brigade.

He also wasn't on the Harvard swim team. (Oddly enough, though, the story Blumenthal likes to tell about owning a necklace of human ears? That one's actually true.)

Blumenthal may as well have shown up for a press conference in a dress. Suddenly, Connecticut is in play!

Naturally, therefore, Republicans are planning on running a World Wrestling Entertainment "impresario" against Blumenthal. Yes, in Connecticut ... a state that is among the wealthiest and most highly educated in the nation ... a state that isn't Minnesota. The average Nutmegger doesn't even know what a turnbuckle is, and that includes me.

Republicans could run Rob Simmons, a Connecticut legislator with a distinguished record of service in the House of Representatives, the CIA, and as a Yale political science professor – who actually did serve in Vietnam, winning two Bronze Stars and retiring as a colonel.

But defeat is so close! Republicans can almost taste the bitterness of yet another crushing loss!

BEWARE THE EMBOLDENED LEFT

As the left rejoices over their monumental victory, conservatives double down on the upcoming 2010 elections and their campaign strategy. "Repeal the Bill" is a good start, but should not be the focus, as it will be a difficult road and Obama will veto any attempt.

The eye-opening shenanigans by the left such as the backroom bribes, payoffs, and threats in their eternal quest for big government; the takeover of the private sector in financial institutions, the car industry, insurance companies, and now health care; their road to a socialistic re-distribution of wealth; the doubling and tripling our deficit .... should be their focus.

More importantly, the conservatives cannot think this is in the bag. Under-estimating Obama's thug policies and the left would be suicide for a conservative comeback. They need to accent on the revulsion the American people are feeling after the actions of the left this past year, and make sure to hold the momentum.

Marc Rotterman write an important piece on the left's attack on conservatives, their movements, and talk radio in American Spectator:

Beware the Emboldened Left
by Marc Rotterman, March 24, 2010

As I write, Congress has just passed Barack Obama's signature issue -- healthcare reform. After a year of stops and starts, imposed deadlines and rancorous debate, President Obama and his allies have prevailed.

He does, in fact, have a victory. And where I come from, a victory is a victory.

Many of my Republican and conservative brethren view this partisan piece of legislation as a stake through the heart of the Left and some are already measuring for new drapes in the Speaker's office.

In fact, in some quarters of the Republican Party "irrational exuberance" has taken hold. Barack Obama's presidency is being compared that of Jimmy Carter.

That, in my view, is a mistake.

Conservatives and Republicans who underestimate President Obama do so at their own electoral peril. Unlike Jimmy Carter, Obama is a true believer, someone who understands that transforming policy translates into votes and a citizenry that is more reliant on the federal government. And unlike Carter, Obama is a streetwise, tough politician who will not give an inch when it comes to his vision of a "New America" -- one that is modeled after European socialism.

Starting now, the Obama administration will try to position him as a modern day LBJ -- getting things done for the middle class and the poor. The administration, and its allies in the mainstream media will echo Obama's belief that he is transformative figure and that healthcare legislation is akin to the historic Civil Rights Act of the 1960s.

And make no mistake about it -- Barack Obama's next agenda item is "immigration reform" which, unless it is defeated, will further broaden the Left's constituency, strengthen the unions, and undermine the rule of law.

By the way, Obama and his team will not stop there. Those who openly oppose Obama's policies will continue to be targets. First the liberal establishment went after Rush Limbaugh and for months now -- former Vice President Dick Cheney. The Left and progressives' newest devil is Glenn Beck and by extension the Fox News network.

One only has to watch MSNBC and its commentators' rants against Beck or read the Washington Post's two recent hit pieces on Fox and Beck -- one by the former discredited New York Times editor Howell Raines, the other by Howard Kurtz, a CNN employee who hosts the CNN show Reliable Sources -- to understand how far the progressives will go to torpedo Beck and Fox.

My point is that Obama and his allies view governing and campaigning in the same context -- "winning" means all out war and by any means necessary. In contrast, Republicans have, in the past, viewed campaigns from a "management perspective."

To compete and to win in 2010 Republicans and conservatives must outline and define what Obama has in store for this nation. And that is the remaking of the nation as we have known it from its inception. We cannot count on a bad economy to propel us to a majority, or outrage over the healthcare bill.

Yes, they are still a very important part of the debate.

But, we have an obligation in our messaging and advertising to illustrate in stark terms what "Obama's transformation" means to America, its families, traditions and culture. In short, we must campaign against the Left as if we were at war.

One thing we know for certain is that Obama and his cohorts are committed to their ideology and they will do what it takes to stay in power. To win, we must understand our opponents and maneuver according to circumstance.

FIVE REASONS NOT TO DESPAIR

We have much to be grateful for, and more importantly, a need to fight on for the all important November 2010 elections. They are only a short 7 months away, and as Erick Erickson of Red State said, the time for fence sitting is over. It's time to choose and campaign with all we've got, and keep our chin up. Proud to be an American.

Rich Lowry writes a great piece on five reasons not to despair in National Review:

Five Reasons Not to Despair
Democrats have won a battle, not the war.
by Rich Lowry, March 22, 2010

If your heart didn’t sink when the Senate bill went over the top in the House last night and Democrats began chanting “Yes, we can” on the floor, you’re either not a conservative or inured to all disappointment. Conservatives will be temped to despair in the weeks ahead, as the magnitude of this defeat and its potential consequences sink in. But there are good reasons not to despair. Here are five:

Public opinion. Democrats were never able to convince the public of the merits of their reform — despite having the highest-profile platforms in American politics, including a president who wore out his teleprompter-festooned bully pulpit for a solid year. Liberals comforted themselves by saying that the bill gained popularity at the end. But look at the Wall Street Journal/NBC News polling on Obamacare. In September 2009, 39 percent thought it was a good idea, 41 percent a bad idea. In January, it was 33 a good idea, 46 a bad idea. The latest poll had it at 36–48 — basically flat from the beginning of the year. Fox News polling had the bill at 38 percent approval and 48 percent disapproval in mid-September 2009, then at 34–57 in December, and 35–55 in its latest survey — again, essentially flat. The public has displayed an irreducible reservoir of common sense throughout the debate, which will be something crucial to draw on during the fights to come.

Structured so can it be overturned. The classic play in entitlement politics is to hook people on the benefits, making repeal impossible and growth inevitable. Obamacare is built so the major benefits, the subsidies, don’t kick in for years. This is part of the fiscal ruse — if the benefits kicked in immediately, Democrats would have exceeded their politically dictated ceiling of $1 trillion in official costs over the first ten years. The delay means there’s time to reverse key aspects of the bill before they take effect.

There’s no doubt that this will be difficult. Democrats have created a fact on the ground in the form of the bill, which puts the power of inertia on their side. Republicans will have to defeat an incumbent president in 2012, never easy. And they will have to offer alternative policy ideas that carry the day. If the odds are against them, all of this is still within the realm of the possible. One way to look at it is that Obama and Nancy Pelosi won the debate within the Democratic caucus over whether to pass a maximalist bill. But they haven’t yet won the debate in the country, which will rumble on.

A moment of clarity. Democrats generally win national elections by posing as moderates. In 2006, congressional Democrats sounded like a reasonable alternative to a corrupt Republican party that was losing a major war. In 2008, Obama usually portrayed himself as a moderate post-partisan; if the nature of Obama’s governance had been blatantly forecast back then, he might not have won, despite the financial crisis, the unpopularity of Bush, and the weakness of McCain’s campaign.

It’s a long time until 2012, but the health-care bill and the way it passed will make it much harder for the president to obscure his ideological commitments. There’s even less reason than before for anyone to misunderstand what Obama and his Democratic party are fundamentally about.

The truth will out. Obama has been saying things about his bill that are untrue: It won’t make premiums go down; it won’t control costs; it won’t allow everyone who likes their current insurance arrangements to keep them. These false representations may well make the bill more unpopular rather than less after passage.

Democrats learned with the stimulus that it’s not much fun to defend a law that they vastly oversold prior to passage. They’ll have exactly the same experience with health-care reform. The legislation on which they’ve staked so much will not withstand its first contact with reality.

The GOP has been better than expected. I remember listening to a Republican congressional leader answer questions about health care at an off-the-record event back in early 2009, and feeling profoundly depressed. He sounded as if he’d already given up. It’s been a very pleasant surprise how Republicans rose to the occasion over the last year. The bill sank in public opinion mostly of its own weight, but Republicans were relentless in their critiques and held together to oppose it. If Mitch McConnell hadn’t held his caucus together, Scott Brown wouldn’t have become the 41st vote and almost brought the bill down. At the health-care summit, Republicans offered an alternative vision for an entirely different direction in reform and found a star to articulate it in Paul Ryan. They couldn’t stop the large Democratic majorities in the House and the Senate from passing the bill, but the way they performed provides hope for the ongoing debate.

None of the above means we should minimize what happened yesterday. It’s a severe blow. But if we are to recover, we can’t despair.

WHY DEMOCRATS DON'T CARE ABOUT $9.7 TRILLION DEBT

Being a very young single mother during the mid-60s and 70s, my liberal upbringing took a beating and got a breath of reality. As I struggled on my own (without depending on anyone or any government) to keep a roof over my little boy's head, food on the table, and clothes on his back, I watched young people collecting welfare, food stamps, free clinics, free eye-glasses, asking me for "some change", while marching themselves in protest of the government that gave them these freebies. College campuses were another great stage for more protests, and let us never forget the likes of Hanoi Hannah, Jane Fonda.

These hypocrites (hippies for short) are now running our government, and are very close to their lifelong goal of redistributing wealth by destroying our economy. But in the process, they have underestimated the American spirit, inbred for many generations, now fighting back to preserve the American Dream and our Founding Father's vision.

Dennis Prager writes an excellent piece, while on holiday in Morocco, where he is witnessing first hand the destruction of our dollar.

Why Democrats Don't Care about $9.7 Trillion Debt
by Dennis Prager, March 9, 2010

As reported by The Washington Post, "President Obama's proposed budget would add more than $9.7 trillion to the national debt over the next decade, congressional budget analysts said Friday."

CNN adds, "Of that amount, an estimated $5.6 trillion will be in interest alone."

The Post continues: "The CBO (Congressional Budget Office) and the White House (are) ... both predicting a deficit of about $1.5 trillion this year -- a post-World War II record at 10.3 percent of the overall economy. But the CBO is considerably less optimistic about future years, predicting that deficits would never fall below 4 percent of the economy under Obama's policies and would begin to grow rapidly after 2015.

"Deficits of that magnitude would force the Treasury to continue borrowing at prodigious rates, sending the national debt soaring to 90 percent of the economy by 2020, the CBO said."

CNN adds that "By 2020 the (CBO) estimates debt held by the public would reach $20.3 trillion, or 90 percent of GDP. That's up from 53 percent of GDP in 2009."

I suspect that most Americans, if asked whether these numbers trouble the Democratic leadership and President Obama, would answer in the affirmative.

They would be wrong.

They would be wrong not because the Democratic Party or the president are economically illiterate or bad individuals, but because the Democratic Party and the president are leftists. And most Americans, including most Democrats, do not understand the left. They may understand liberalism; but President Obama, Nancy Pelosi, Harry Reid, and most Democratic representatives and senators are not liberals; they are leftists. And most Americans do not understand the difference between liberal and left. They do not realize, for example, that there is no major difference between the American Democratic Party and the leftist social democratic parties of Western Europe. They do not know that from Karl Marx to Obama, the left (as opposed to liberals) has never created wealth because it has never been interested in creating wealth; it is interested in redistributing wealth.

Therefore, unprecedented and unsustainable debt, a debt that will negatively affect most Americans' quality of life, renders the dollar increasingly undesirable, and undermines America's prestige and power in the world -- these developments do not particularly disturb the left. They may trouble the president, the Democratic Party, and others on the left on some political level, but that pales in comparison to what the left really wants: a huge government overseeing a giant welfare state and a country with far fewer rich Americans.

Achieving those goals is far more important than preventing a decline in the American quality of life. The further left one goes, the more contempt one has for the present quality of American life in any event. The left regularly mocks many of the symbols of that life -- from the three-bedroom suburban house surrounded by a white picket fence to owning an SUV (or almost any car) because Americans should be traveling on public buses, trains and bicycles.

As for the dollar, I can bear personal testimony to the decline of the dollar's prestige. I am writing this column in Morocco. In Casablanca, my wife and I and another couple hired a Moroccan driver for the day. And when it came time to pay, the man refused to accept dollars; he wanted to be paid in either Euros or Moroccan dirhams. Yes, dirhams rather than dollars. But the demise of the dollar as the world's currency disturbs the left as much as does America's not getting a gold medal in curling at the Winter Olympics.

And as for America wielding less power in the world, that is a positive development for the American left. It is the world community as embodied in the United Nations that should wield power throughout the world, not an "overstretched," "imperialist" and "militarist" United States.

I used to believe that left and right have similar goals for America, that they just differed in the means they wanted used to get there. I was mistaken. The left has a very different vision of America than those who hold the founding values of America, most especially individualism and small government. And if the price of a once in a lifetime possibility of getting to a giant welfare state dominated by the left is America's steep financial decline, that is a price fully worth paying.

WHAT IS "RECONCILIATION" AND WHY IS IT A THREAT?

Ever notice when the Republicans used the reconciliation process, it was called Nuclear. But when the Libs use it, it's conveniently called reconciliation, euphemistically now called "a majority vote". This is an excellent dissertation on the use of "Reconciliation" by Newt Gingrich at Human Events:

What Is "Reconciliation" And Why Is It A Threat?
by Newt Gingrich, March 3, 2010

During last week's health summit, Senate Majority Leader Harry Reid uttered a remarkably dishonest and, in retrospect, ironic statement, claiming that "nobody is talking about reconciliation" to pass the health bill.

It was a dishonest statement because Democrats have been openly floating the specter of passing the health bill using reconciliation since it first became obvious it would have difficulty passing the Senate, including just days before the summit by Sen. Reid himself.

It was ironic because it seems that all the cable news shows, talk radio, blogs and pundits have been talking about since the summit is whether President Obama, Harry Reid, and House Speaker Nancy Pelosi will use the Senate budget reconciliation process to pass their big government, big bureaucracy health bill.

But what exactly is the reconciliation process? And why, exactly, is it so controversial a move to pass the health bill?

A Tool for Congress to Meet Spending Goals

The budget reconciliation process was created in 1974 as part of the law that created much of the modern rules and organizational structures used by Congress to pass the annual budget.

This new law required Congress to pass a budget resolution every year that would set the parameters by which the various congressional committees would write their specific parts of the total budget bill.

Within these budget resolutions, instructions can be given to specific congressional committees to create legislation that would alter current laws affecting spending and/or taxation in order to conform to the targets set out in the budget resolution.

To enhance Congress’ ability to meet budget resolution targets, these pieces of legislation are not passed under the normal rules of the Senate. Instead, they fall under the “budget reconciliation process” rules which prohibit unrelated amendments to the bills and set a maximum of 20 hours of debate on the floor. As a practical matter, this means only 51 votes are needed to pass a reconciliation bill because the limit on debate overrides the threat of a filibuster.

The Byrd Rule to Prevent Abuse of Reconciliation

While the budget reconciliation process was a success in its principal goal of giving Congress more power to meet the spending and revenue goals of the budget resolution, it quickly became prone to abuse.

Provisions that had nothing to do with meeting budget resolution requirements, even some that directly contradicted them, were passed using the reconciliation process.

To prevent this, the so-called “Byrd Rule,” named after Democratic Sen. Robert Byrd, who introduced the legislation, was passed in 1985 and made permanent in 1990.

The Byrd Rule allows any senator to raise a point of order objection to provisions in a reconciliation bill that they consider extraneous to meeting budget resolutions requirements.

Then, it is up to the chair – either the Vice President (as President of the Senate) or, more often, the presiding officer of the Senate if the Vice President is not present -- whether that provision stays or is stricken.

However, the chair almost always relies on the advice of the Senate Parliamentarian to determine if that objection is legitimate. (Learn more about the parliamentarian here.)

This determination is made based on six tests created as part of the Byrd Rule used to weed out provisions that have nothing to do with raising or reducing taxes or spending. It takes a 3/5 majority vote to override the decision of the presiding officer if he or she finds that a provision violates one or more of these tests. (This Congressional Research Service report is a good primer on the Byrd rule if you want to learn more.)

Reconciliation in Action

Reconciliation has been used for 22 bills, of which, 14 were passed by Republican majorities. Nineteen of those bills were signed into law by the President. Three were vetoed. You can view a chart of these bills here.

Notice the similarity between them? All of these bills were obviously directly related to taxation and spending, and since 1985, have successfully met the Byrd rule tests.

Health Reform Is About More than Federal Spending

This is why passing the left's big government, big bureaucracy health bill using the budget reconciliation process is so fundamentally dishonest and dangerous to Senate precedent.

Leaving aside the bill's merits (which, to be clear, are abysmal), both its defenders and detractors would acknowledge that it is, for better or worse, a fundamental overhaul of the nation's health system, both public and private. It sets new rules and regulations that span the entire healthcare sector. It is much larger in scope and more all encompassing in purpose than simply affecting federal spending and revenues.

This is not to say that the bill would not have some effect on the federal budget. Almost any piece of legislation could meet that meager standard.

The reconciliation process was only intended to be used for legislation directly related to meeting budget resolution spending and revenue goals.

The minor affect the left's health bill would have on the deficit over 10 years (beyond that there is every reason to think it would increase the deficit substantially), even by charitable estimates, cannot be used to justify passing this sort of sweeping legislation using reconciliation.

This is one reason why a number of Democrats, including Sen. Robert Byrd, author of the Byrd Rule and who also helped create the budget reconciliation process in 1974, called the idea of using it to pass the health bill (and cap and trade) "an outrage that must be resisted."

It's also why Robert Byrd objected to President Clinton's efforts to pass Hillarycare in 1993 using reconciliation.

Why should the left's latest big government healthcare grab be held to any different standard?

Welfare Reform vs. the Left's Big Government Health Bill

This week, the left is out in force, pointing to other significant pieces of legislation passed by Republicans using the budget reconciliation process as justification for passing their health care bill. One of the examples they are using is welfare reform.

Since welfare reform was passed while I was Speaker of the House, I am happy to compare the two cases.

First, welfare reform was an integral part of the Republican Congress' efforts to balance the budget, producing immediate savings of over $50 billion dollars between 1997 and 2002. It was originally combined with the balanced budget act that President Clinton vetoed in 1995.

By contrast, for most of the debate over the health bill, the left has constantly boasted about how their bill was "deficit neutral". President Obama repeatedly sought to assure the American people that he would not sign a bill that "added one dime" to the deficit. Medicare cuts were combined with new taxes to pay for the cost of new programs and bureaucracies.

So while real effective health reform would certainly have a positive effect on the deficit, it is clear that the left never intended for their health bill to be primarily a budget bill. Its focus was and still is on getting more people covered. It was only after Democratic leaders began setting the stage for passing the bill using reconciliation that they began emphasizing it as a way to reduce the deficit. (Paul Ryan explains here how their bill uses smoke and mirrors to create the illusion of savings).

Second, when we decided to roll welfare reform into the balanced budget bill in 1995, we never stopped the conference committee efforts to resolve the differences between the versions of the welfare reform legislation that passed in the House and Senate earlier in the year. This continuation of work, along with the active participation of the governors, allowed us to quickly produce the final bill in conference the next year, once it became clear that President Clinton was now finally ready to sign welfare reform.

In contrast, the Democrats have done an end run around the conference committee process that would resolve the differences between the House and Senate bills, instead trying to negotiate their final bill in secret at the White House. This process continues today, with President Obama, Nancy Pelosi, and Harry Reid exploring different tricks they can use to ram a bill through their respective chambers without first producing a conference bill.

Third, welfare reform was passed with overwhelming bipartisan support, with more Democrats voting for it in the House and Senate than opposing it. It was signed by a Democratic President. Bipartisanship was integral to the success of the bill.

Today, Democrats are turning to passing the bill using the reconciliation process precisely because they are rejecting bipartisanship. Republican Scott Brown's stunning election in Massachusetts, thanks largely to opposition to the left's health bill, has meant that the Democrats would need at least one Republican vote to break a filibuster in the Senate. And their bill is so bad they can't get one.

Finally, and perhaps most importantly, welfare reform was overwhelmingly popular with the American people. One poll showed that over 90 percent of Americans favored reform, including 88 percent of those on welfare.

As for the left's health bill, after a year of debate and discussion, the American people have overwhelmingly rejected it. A poll we released at the Center for Health Transformation showed that it is opposed by a 2-1 margin. It is a fact that the more Americans learn about the left's plan, both its substance and the corrupt manner in which it has been passed, the more they oppose it.

Three Corrupt Options for the Left

The left's big government, big bureaucracy health bill is overwhelmingly unpopular with the American people. It is incapable of obtaining any bipartisan support in the Senate.

Faced with this reality, President Obama, Nancy Pelosi and Harry Reid should do the responsible thing and scrap the unpopular bill and start over, focusing instead on smaller pieces of legislation that could obtain bipartisan support.

However, they've made it clear they aren't willing to do this. The Democrats are determined to pass a comprehensive health bill no matter how unpopular it is. This means they have to use reconciliation to avoid needing 60 votes to end debate in the Senate.

There are several corrupt options available to the Democrats using reconciliation.

One option would be for the House to pass the exact same health bill the Senate passed in December (thus avoiding the need for the Senate to marshal 60 votes again for a final bill now that Scott Brown is in office) with an understanding that a separate bill with a series of fixes would be passed immediately afterward using the budget reconciliation process in the Senate.

The left argues that technically, this would keep the use of reconciliation fairly narrow. However, the plain truth of the matter is that the Democrats would be using the budget reconciliation process to pass a bill they could not otherwise pass using the normal legislative process. It is a dirty trick that ignores congressional tradition and the overwhelming opposition to the bill from America.

Another option is for the Democrats to try and pass the full health bill in the Senate with 51 votes using reconciliation and then for the House to pass the same bill that emerges from the Senate.

For all the reasons outlined above, this would be an enormously inappropriate use of the budget reconciliation process. But it also means that the left's endlessly complicated bill that creates hundreds of new regulations, new programs, and new bureaucracies would have to survive the Byrd Rule tests, creating the possibility that by the time all the extraneous provisions are removed, the final "swiss cheesed" legislation would be unrecognizable.

For President Obama, Nancy Pelosi and Harry Reid to promise to pass a bill when they, in reality, don't know what the final bill will look like, is the height of irresponsibility. (Of course, they passed the stimulus without reading it so it would certainly fit with their precedent.)

How Far Are The Democrats Willing To Go?

Which brings us to a third, more drastic option for the Democrats to get their high tax, big government, big bureaucracy health bill passed.

As explained above, under the Byrd Rule, the vice president of the United States is ultimately responsible for deciding whether a provision in a reconciliation bill is extraneous. It is merely tradition that dictates he follow the advice of the parliamentarian, not a Senate rule.

To avoid their legislation being subjected to Byrd Rule tests, the vice president could choose simply to ignore the advice of the parliamentarian on points of order and rule to keep the extraneous provisions in the final bill. Any senator can appeal these rulings, but the appeal may be defeated with a simple majority vote.

To be clear, no vice president has ever acted in this fashion in the history of the reconciliation process. But no one has ever tried to push this kind of bill through reconciliation before either.

With the American people overwhelmingly opposed to the health bill, not to mention every other part of the left's agenda, and the political environment turning increasingly toxic for the Democrats, President Obama, Harry Reid and Nancy Pelosi could decide to make a cynical, calculated political decision.

Faced with the high likelihood of political defeat in November, they could decide it is preferable to pass the bill they want and be defeated rather than to fail to get a health bill (or only a partial bill), and be defeated anyway.

In fact, this seems to be the message Speaker Pelosi was pushing this past weekend, dismissing her caucus' concerns of defeat.

Republicans Must Vow To Replace the Left's Health Bill

If the Democrats are bound and determined to exert all their power and manipulate every rule they can to pass their big government health bill, Republicans may not be able to stop its passage.

We'll find out today as President Obama is set to announce his recommendation on the way forward.

But no matter what President Obama, Speaker Pelosi and Majority Leader Reid decide, the bottom line for Republicans is that they must stand with the American people in opposing this bill.

This doesn't just mean voting against it and using every parliamentary maneuver available to delay its passage.

It also means running on a platform of replacing whatever left-wing health bill the Democrats manage to pass with real health reform that empowers patients and doctors, not bureaucrats, to bring down health costs. And delivering on that promise in 2011 if Republicans gain control of Congress.

And if President Obama is still determined to ignore the will of the people by vetoing the Republican bill after such a clear message from America, it means that the Republican candidate for President in 2012 must run on a platform that includes signing the replacement of the left's big government health bill. After all, no matter what dirty tricks the politician may try to get his way, in America, the people have the final say.

THE SHAM WOW SUMMIT

Yesterday was a glorious day. The Republicans finally had their day in court, and they came well prepared. It's not as though this is new to them. They have been trying to get their ideas on the table for over a year, and have been dismissed, ignored and shut out for the same amount of time. The Republicans looked intelligent, thoughtful, articulate and committed, while Obama looked more obvious that ever before. His contempt, antipathy, arrogance and loathing was so apparent it was almost laughable, except for the fact this man is in the White House.

After a year of anguish, frustration and sorrow for Americans who have felt their sovereignty slipping away, Obama's dog and pony show "summit" was a sight to behold.

Erick Erickson of Red State has a great piece on this today:

The Sham Wow Summit
by Erick Erickson, Febryary 26, 2010

There are many reasons the Republican Party is often referred to as the Stupid Party. Many Republicans thought that after the President overshadowed the GOP at their Baltimore retreat last month, going to Blair House yesterday would just be another PR disaster.

It was anything but.

The GOP won the day so convincingly that even the traditional media had to praise the party for talking issues.

Contrast that with Barack Obama who scowled, berated, lied, and harassed the attendees — not to mention filibustered them.

In the most ironic moment of the day, Barack Obama lectured Virginia Congressman Eric Cantor on having the Democrats’ 2,700+ page health care bill on his desk at the meeting. Obama called it a “prop.” At the same time, Democrats were in the newspapers admitting that, in effect, Barack Obama was using the GOP as a prop in a vain effort to show bipartisanship on health care.

There is bipartisanship on health care. There is bipartisan opposition to it. The Democrats must realize today that they would get nothing out of the meeting. They will now try to force health care deform through Congress on a majority vote in each house.

Only a couple of years ago, Barack Obama praised the filibuster claiming it was what the founding fathers wanted to prevent the tyranny of the majority. Now he is intent on ignoring the filibuster and ramming through health care deform.

If nothing else, today shows the American public that the Republicans have a better agenda, better ideas, and are willing to stand up and oppose a reckless scheme that will increase health care costs.

TECHNOCRACY: THE DEMOCRATS' TECHNOLOGICAL THUGGERY

We have all heard about the corruption of politics, but not with the force this administration has wielded. We not only heard about it, but witnessed it in a front row seat. The Democrats always overreach, but this time it was in your face, to use one of Obama's favorite idioms. A classic example of things to come was the scene outside a Philadelphia polling place with Black Panther thugs wielding nightsticks intimidating white voters [charges mysteriously dismissed], but most people didn't want to face that little tidbit.

After being dismissed as unruly children, we have seen the likes of Pelosi, Reid and Obama ignore the cries of the American people, shutting them out to make the decisions they want to make while blaming their opponents for it not working and blaming the private sector. Talk is about all they do best, because the actions do not support the rhetoric. This is why you have to focus on their actions, not the words.

Although Obama may have lost his lockhold, he still has a lot of power, enough to do great damage to this country in the next three years. He has his Article 2 powers, and that in itself is enough to scare the living daylights out of every freesom loving citizen.

An excellent piece about this treachery by Phil Elmore in World Net Daily:

Technocracy: The Democrats' Technological Thuggery
by Phil Elmore, January 21, 2010

Force is technology.

It is crude technology, but it is technology nonetheless. Technology is the application of a tool or tools to human effort. This produces a result greater than can be accomplished without the tools used. In the case of naked force, technology could be a clenched fist wielded with intent – or it could be the truncheon in the white knuckles of a Black Panther who is bullying elderly voters.

The technology of force can also be thieving, manipulation and intimidation of any democratic or bureaucratic process, in this case as nationally exhibited by the Democratic Party. Force, as misused by the Democrats, is the application of violence, abuse of process, libel, slander, propaganda, theft and a variety of other criminal behaviors to gain and keep, through any means necessary, the power to rule, arrogantly and presumptuously, every miniscule facet of your waking life.

Democrats engage in this reprehensible, morally bankrupt, hypocritical behavior even as they breathlessly exclaim that their political opponents mean them harm. The example that springs most readily to mind is the bug-eyed, botox-paralyzed, Medusan visage of Nancy Pelosi as she feigned crocodile tears at the thought of those awful, mean "tea party" people waving imaginary Nazi symbols and somehow implying violence because they dared to oppose the socialization of American health care.

Meanwhile, as hand-wringing Democrats engaged in these histrionics, their union thugs were beating protesters in an effort to silence them. A supporter of socialized medicine bullied, assaulted and then bit off the finger of an older man who dared to oppose Obamacare. Supporters of amnesty for illegal aliens attacked Americans opposed to the invasion of their nation. Conservative protesters were pepper-sprayed and beaten by homosexual activists.

Republican protesters risk their well-being whenever they dare to stand up for their political beliefs – and the left-leaning popular media turn a deliberately blind eye to their Democrat fellow travelers' crimes. While all this was going on, Democrats and the media were falling over themselves laughing to redefine "tea party" protesters as "teabaggers," a sexually vulgar term that left-wingers across the mainstream media are now free to use with impunity. Winking and nudging your co-anchors while uttering the word is optional, incidentally.

Take Steven Benen, for example. Benen's a typical liberal whose first reaction to the news of Kenneth Gladney's beating by SEIU thugs was to sneer that, well, if the guy could still walk around afterward, it couldn't have been a very big deal. Why, conservatives must have been busily manufacturing a cause celebre ... and why doesn't Gladney have health insurance? Benen was, in fact, much more concerned with who was paying Gladney's hospital bill than he was with the assault on a black conservative.

That black man – whom Benen apparently thought probably deserved a good roughing up – was one of the many people MSNBC's execrable Contessa Brewer condemned as "racist" for daring to oppose Obama's socialist agenda. Considering the topography of left-wing political beliefs, the reasonable man finds a disturbingly large number of Democrats who are entirely comfortable with the thought of roughing up their political opponents. Failed Democratic Senate candidate Martha Coakley certainly had no problem with one of her aides knocking down a reporter for the Weekly Standard. Who do those conservative journalists think they are, after all?

When they're not libeling or beating their opponents, Democrats are busily changing the rules to their benefit in the middle of the political process. Never was this more obvious than in the battle over the Senate seat vacated by the late Ted Kennedy. Democrats in Massachusetts changed the law half a decade ago to stop then-Gov. Mitt Romney from appointing a Republican Senator to fill the seat that would have been vacated by John Kerry (had he become president). The Democrats then changed the process back so a Democratic governor could appoint a Democrat to fill Kennedy's seat after "the Lion of the Senate" died of cancer. When the people finally got to vote on that seat and put a Republican in office, it threatened the 60-vote majority needed to prevent a Republican filibuster in the Democrat-ruled Senate.

The Democrat response? The lisping, bloated self-parody that is Barney Frank sputtered and stammered and spat his way through a statement in which he hinted that the Democrats might do away with the filibuster to prevent this challenge to their imperial reign. This shouldn't surprise us at all; it wasn't too long ago that MSNBC host Ed Schultz said he was perfectly OK with vote fraud to keep those "bastard" Republicans out of office.

In the vote-fraud department, illegitimate officeholders like Al Franken are way ahead of Schultz. Franken stole his Minnesota Senate seat from Norm Coleman by (as tried and true for Democrats) changing the rules in the middle of the process – manipulating the recount of a close election to usurp that election's rightful winner. We can thank the precedent set by Democrat Al Gore in his attempts to commit similar theft of a presidential election.

The damning evidence is clear: Democrats are violent, corrupt, arrogant and self-righteous. A Democrat believes that his cradle-to-grave ideology makes him special. Whatever a Democrat does is justified in his mind as what is best for the masses, regardless of whether the proles know what is good for them.

The Democrats will continue to lie, to cheat, to steal and to trample the Constitution of the United States. They will be removed from power only through the most vicious of battles, and they will have to be dragged, kicking and clawing and screaming, from the table of government. The technology of their tyranny is all around us. The infrastructure of their arrogant imperialism is inescapable. Only when we are willing to acknowledge the fact of their thuggery will we have even the slightest hope of combating it. Only when we admit publicly that Democrats individually are villains will we have any chance of overcoming them.
